Terms of Service

These Terms govern your use of Piknup, the AI receptionist for trade service contractors. Piknup is operated by Boltpath LLC, a New Mexico limited liability company ("Boltpath," "we," "us"). By signing up for an account or paying for a subscription, you agree to these Terms and to Paddle's Buyer Terms presented at checkout. If you do not agree, do not use Piknup.

1.Acceptance of these Terms

Creating an account, subscribing, or sending an SMS through Piknup means you agree to these Terms. If you sign up on behalf of a business, you confirm you are authorized to bind that business.

2.Who provides Piknup, and who sells it

Boltpath LLC builds and operates the Piknup service. For every paid subscription, Paddle.com Market Limited ("Paddle") acts as the Merchant of Record / reseller. Paddle handles checkout, billing, sales tax and VAT collection, refund processing, and chargebacks on Boltpath's behalf. Paddle's Buyer Terms and Privacy Notice govern the payment relationship. These Terms govern your use of the Piknup service itself.

3.What Piknup is

Piknup texts back missed callers in the contractor's voice, qualifies the job over SMS, and books the appointment. It is a tool, not a replacement for human judgment. Piknup does not guarantee booked jobs, lead capture rates, or revenue lift, and is not a regulated utility, telecom, or financial service.

4.Eligibility

You must be at least 18 years old, operate a US-based business, and be authorized to act on behalf of that business. Piknup is not sold to consumers for personal use.

5.Account responsibilities

Keep your credentials secure. Provide accurate business information. Send and receive messages only on behalf of your own business. Do not use Piknup for spam, illegal contact, or any activity that violates carrier rules or applicable law.

6.Pricing and billing

Piknup is sold by Paddle as Merchant of Record at $79/mo for the founding plan (locked for life for the first 50 contractors who subscribe) or $99/mo on the standard plan after the founding cohort fills. Subscriptions renew monthly. Paddle calculates and adds applicable sales tax or VAT at checkout based on your location.

We may change prices on at least 30 days' notice. Founding-50 contractors are exempt from price increases for as long as they maintain an active, paid subscription on the founding plan.

7.Cancellation

Cancel any time from the Piknup dashboard, through the Paddle customer portal link in any billing email, or by emailing contact@piknup.com. No annual contracts. No early-termination fees. Cancellation takes effect at the end of the current billing cycle and you keep access until then.

8.Acceptable use

You agree not to:

  • Scrape, reverse-engineer, or attempt to extract source code
  • Resell, sublicense, or repackage Piknup access
  • Send unsolicited marketing or any communication that violates the TCPA, A2P 10DLC requirements, or applicable state SMS laws
  • Impersonate another contractor, business, or person
  • Bypass any rate limit, security control, or carrier registration requirement

9.SMS, consent, and the sender of record

You are the sender of recordfor every SMS Piknup sends on your behalf. You are responsible for ensuring you have prior express consent under the TCPA from any phone number you proactively message. Piknup's reactive use case (replying to inbound missed calls) operates under implied consent because the caller initiated contact, but the sender-of-record obligation still rests with you. Piknup honors STOP and HELP keywords automatically within the carrier-required window.

10.Intellectual property

Boltpath retains all rights to the Piknup platform, AI prompts, prompt-engineering methodology, software, and brand. You retain all rights to your business data: call logs, customer information, conversation history, and voice samples. You can export your data at any time.

11.Disclaimers

Piknup is provided "as is" and "as available." We do not warrant uninterrupted service or error-free operation. AI-generated responses are not legal, medical, financial, or professional advice. We do not guarantee any specific business outcome.

12.Limitation of liability

To the fullest extent permitted by law, Boltpath's total liability to you for any claim arising out of or related to Piknup is capped at the total amount you paid for the service in the 12 months immediately preceding the claim. Boltpath is not liable for lost profits, lost jobs, lost revenue, lost data, or any indirect, incidental, special, exemplary, or consequential damages.

13.Indemnification

You will indemnify, defend, and hold Boltpath harmless from any third-party claim, fine, or penalty arising from your misuse of Piknup, including violations of the TCPA, A2P 10DLC requirements, or any state SMS-consent law caused by your conduct, your customer list, or messages you instruct Piknup to send.

14.Termination by Boltpath

We may suspend or terminate your account for material breach of these Terms, fraud, illegal activity, or A2P 10DLC violations that put our carrier relationships at risk. We will provide prior notice where reasonable.

15.Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, and federal law where applicable. You and Boltpath agree any dispute arising under these Terms will be resolved in the state or federal courts located in New Mexico. Paddle's separate Buyer Terms govern any dispute about the payment leg of a transaction.

16.Changes to these Terms

We may update these Terms over time. For material changes, we will email you at least 14 days before the change takes effect. Continued use of Piknup after the effective date counts as acceptance of the updated Terms.
